In this Note the Standing committee of experts in international immigration, refugee and criminal law concludes that the proposed inclusion of four categories of British subjects who are not British nationals for the purpose of Community law in Annex I of the Regulation is incompatible with Article 6(2) EU Treaty and will violate the obligations of Member States under Article 1(1) and Article 2 of the Convention on the
Elimination of All Forms of Racial Discrimination, under Article 3 and Article 14 ECHR and under Article 26 of the International Covenant on Civil and Political Rights. The Standing Committee suggests that the European Parliament should in its opinion propose to amend the Commission’s proposal in order to make it compatible with international human rights law. Moreover, the Parliament could consider using its power under Article 230 EC Treaty, in case the Council would adopt the proposal and oblige Member States to introduce a visa requirement for certain categories
