CM1905 Note of the Meijers Committee on the extension of the competence of the European Public Prosecutor’s office to terrorist offences

 

In its State of the Union of 2018, the European Commission announced that it would take the initiative in a discussion on extending the competences of the European Public Prosecutor’s Office beyond criminal offences that affect the financial interests of the European Union. In its view, the Office should also be made competent for cases of cross-border terrorism.The Meijers Committee wishes to make some remarks regarding this initiative.

CM1904 Comments on the proposal for a Regulation on preventing the dissemination of terrorist content online (COM(2018) 640 final)

The Meijers Committee would like to take the opportunity to comment on the Proposal for a Regulation on preventing the dissemination of terrorist content online (COM(2018) 640 final). The Meijers Committee provides for input in the legislative procedure, to encourage an appropriate and proportionate balancing between, on the hand, the need for effectively combatting the distribution of terrorist content, and, on the other hand, the freedom of expression and information, as laid down in Article 11 of the EU Fundamental Rights Charter.

CM1903 Note on the Position of UK nationals living in the EU in the case of a No Deal Brexit

The Meijers Committee wishes to bring to the attention of the EU Institutions the position of UK nationals living in the EU in the case of a No Deal Brexit. These UK nationals used their rights as citizens of the European Union. Under EU law, Union Citizenship is destined to be the fundamental status of nationals of the Member States.

CM1902 ECRIS-TCN and the fundamental right to non-discrimination

The Meijers Committee took notice of the final compromise text regarding the Regulation on ECRIS-TCN.According to Article 2 of this proposed text, the ECRIS-TCN database will contain information of both third-country nationals (TCN) and Union citizens who also have the nationality of a third country. Thus, Article 2 for the first time introduces in EU law a difference in treatment between dual and mono Union citizens, those who also have the nationality of a third country and Union citizens who only have the nationality of a Member State.

CM1901 Herziening gesubsidieerde rechtsbijstand in asielzaken

De Commissie Meijers heeft kennis genomen van de brief van 16 november 2018 van de Staatssecretaris van Justitie, waarin onder meer het voornemen is vervat om de gefinancierde rechtshulp aan asielzoekers te beperken. De Commissie Meijers heeft ernstige bedenkingen bij dit voornemen en is van oordeel dat het een onaanvaardbare afkalving van de rechten van de asielzoeker vormt. De ondermijning van de rechtspositie van asielzoekers dreigt voorts in strijd te komen met toekomstige Unierechtelijke wetgeving.
