The recommendation includes a series of measures to improve journalists&#8217; safety, to end attacks against journalists and to stop the legal and other types of harassment that journalists regularly face, such as SLAPPs. Press organisations, such as <a href=\"https:\/\/ipi.media\/mfrr-partners-welcome-european-commissions-recommendation-safety-of-journalists\/?mc_cid=3431bf87ac&amp;mc_eid=244066d54f\" target=\"_blank\" rel=\"noopener\">IPI<\/a>, welcome the recommendations but also warn that the efficiency of such recommendations might be hampered by insufficient implementation.<\/p>\n<p><strong>Rule of Law Report will include specific recommendations in the future. <\/strong>The Commission has announced that it is changing its Rule of Law Report to include country-specific recommendations. Many have criticised the limited value of the rule of law report due to its descriptive nature and its lack of impact on the rule of law situation in the EU.<\/p>\n<hr \/>\n<h5>Upcoming Events in October<\/h5>\n<p><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">6 October<\/span>: the <strong>CJEU will<\/strong><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"><strong> publish its judgment in the case<a href=\"https:\/\/curia.europa.eu\/juris\/liste.jsf?oqp=&amp;for=&amp;mat=or&amp;lgrec=de&amp;jge=&amp;td=%3BALL&amp;jur=C%2CT%2CF&amp;num=C-487%252F19&amp;page=1&amp;dates=&amp;pcs=Oor&amp;lg=&amp;pro=&amp;nat=or&amp;cit=none%252CC%252CCJ%252CR%252C2008E%252C%252C%252C%252C%252C%252C%252C%252C%252C%252Ctrue%252Cfalse%252Cfalse&amp;language=en&amp;avg=&amp;cid=5617963\" target=\"_blank\" rel=\"noopener\"> C\u2011487\/19 W.\u017b.<\/a><\/strong> (a referral from a Polish Court). C-487\/19 concerns the question whether a panel composed of a judge from one of the new Chambers of the Polish Supreme Court is an independent and impartial tribunal established by law, according to EU law. It thus touches crucial rule of law aspects such as judicial appointments, the status of neo-National Council of Judiciary and the independence of judges that were appointed with its participation.<\/span><\/p>\n<p>7-8 October 2021: <strong>Probing Democracy<\/strong> organised by the Central European University, can be followed online as well, more information <a href=\"https:\/\/events.ceu.edu\/2021-10-07\/probing-democracy\" target=\"_blank\" rel=\"noopener\">here<\/a>. The parliamentary elections will be held on the same day as the presidential elections. Withholding EU funding is agreeable for a certain time, but going too far in this row might turn out to be counteproductive. <span lang=\"EN-US\">Read more on <a href=\"https:\/\/www.euractiv.com\/section\/politics\/news\/far-right-parties-lead-italian-polls\/\" target=\"_blank\" rel=\"noopener\">Euractiv<\/a>, 9 September 2021.<\/span><em><span lang=\"EN-US\"><br \/>\n<\/span><\/em><\/p>\n<\/div>\n<hr \/>\n<h5>Hungary<\/h5>\n<p>European Parliament delegation on the rule of law to carried out a <a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20210923IPR13416\/rule-of-law-in-hungary-meps-to-meet-government-ngos-and-opposition\" target=\"_blank\" rel=\"noopener\"><strong>fact-finding\u00a0mission to Budapest<\/strong><\/a> from 29 September to 1 October. The delegation under the lead of MEP Gwendoline Delbos-Corfield was especially concerned about the use of spyware on journalists and oppostion that was revealed by the Pegasus Project. You can watch the press conference given by Delbos-Corfield about the fact-finding mission to Budapest <a href=\"https:\/\/multimedia.europarl.europa.eu\/en\/press-conference-by-gwendoline-delbos-corfield-head-of-ep-libe-delegation-to-budapest_20211001-1500-SPECIAL-PRESSER_vd\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>On 26 September 2021, the<strong> p<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">rimary elections of Hungary\u2019s opposition alliance <\/span><\/strong><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">took place. Hungary\u2019s opposition parties <a href=\"https:\/\/www.politico.eu\/article\/inside-the-hungarian-opposition-uphill-battle-to-beat-viktor-orban-fidesz-party\/?utm_source=POLITICO.EU&amp;utm_campaign=ac51488a2c-EMAIL_CAMPAIGN_2021_09_20_05_19&amp;utm_medium=email&amp;utm_term=0_10959edeb5-ac51488a2c-190703400\" target=\"_blank\" rel=\"noopener\">have formed an alliance<\/a> in an attempt to defeat Prime Minister Viktor Orb\u00e1n\u2019s Fidesz party next year&#8217;s election. There were reports about <strong>hacking of the opposition primary<\/strong> as online voting was disrupted for days, some claim Chinese hackers are responsible for this. Klara Dobrev, the leftist Democratic Coalition&#8217;s candidate, won the first round of opposition primary vote just ahead of another leftist, Budapest mayor Gergely Karacsony, both campaigned on a pro-European agenda. Read more on <a href=\"https:\/\/www.reuters.com\/world\/europe\/pro-eu-dobrev-leads-opposition-primary-take-hungarys-orban-2021-09-30\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a>, 1 October 2021.<\/span><\/p>\n<p><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"><strong>The Hungarian Parliament extended the force of the Authorization Act until 31 December 2021 and thus prolongues the rule-by-decree emergency regime<\/strong> introduced due to the Covid-19 pandemic. Read more about how this grants the government excessive regulator powers in this regularly updated article by the <a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2021\/09\/HHC_Hungary_emergency_measures_overview_27092021.pdf\" target=\"_blank\" rel=\"noopener\">Hungarian Helsinki Committee<\/a>, <span id=\"page3R_mcid57\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">27 September 2021,<\/span><\/span><br \/>\n<\/span><\/p>\n<p><strong>New revelations about the Pegasus spy-ware that was used on journalists and opposition members. <\/strong>Direkt36 revealed that D\u00e1niel N\u00e9meth has been recently <span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">targeted and surveilled with the Pegasus spy-ware &#8211; the spying occured after the revelations were made public. Direkt36 also found out that a publisher of an anti-Orb\u00e1n news site came under surveillance on the same day Hungary&#8217;s largest opposition party uploaded information about a contract with this news site to the parliament&#8217;s website (<a href=\"https:\/\/twitter.com\/direkt36\/status\/1437466414621790210\" target=\"_blank\" rel=\"noopener\">Tweet<\/a> by Direkt36 on 13 September 2021). <\/span><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">The Hungarian government in the meantime has been doing its best to block parliamentary hearings about the Pegasus Project from taking place. In a recent hearing, Orb\u00e1n\u2019s cabinet members not only refused to give clear answers about the use of spyware against journalists, the opposition and other targets, it also classified everything they have said in this hearing until 2050 (<a href=\"https:\/\/twitter.com\/panyiszabolcs\/status\/1440034110915837969\" target=\"_blank\" rel=\"noopener\">Tweet<\/a> by direkt36-journalists <\/span><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">Szabolcs Panyi on 20 September 2021). <\/span>On 15 September 2021, the European Parliament discussed the Pegasus project. Hungary<\/a>: the Committee of Ministers of the <strong>Council of Europe calls on Hungary to present the steps taken by the Hungarian government aimed at executing the judgment issued in 2016 in the <em>Baka v. Hungary<\/em><\/strong> case, <a href=\"https:\/\/helsinki.hu\/en\/the-council-of-europe-is-losing-its-patience-in-the-baka-case\/\" target=\"_blank\" rel=\"noopener\">Hungarian Helsinki Committee<\/a>, 20 September 2021.<\/p>\n<p><strong>EU anti-fraud watchdog OLAF loses access to documents case against Hungarian civil association<\/strong> after Court finds the protection of inspections cannot serve as a reason to refuse access after such inspections are closed. Read more about the case on <a href=\"https:\/\/www.eu-opengovernment.eu\/?p=2825\" target=\"_blank\" rel=\"noopener\">Open Government in the EU<\/a>, 13 September 2021.<\/p>\n<p><strong>Businesses with close ties to Fidesz and Orb\u00e1n land government deals favourable to them<\/strong>. Recently, <a href=\"https:\/\/telex.hu\/gazdasag\/2021\/09\/07\/nagy-titokban-35-eves-kaszino-koncessziokat-kaptak-garancsi-istvanek-cege?utm_source=piano&amp;utm_medium=email&amp;utm_campaign=13520&amp;pnespid=tuRpBiBAMLgcxvPY.Sq0F56RogC2VJguPOmsnOI1.hdmWWc8c1vgVOng_Hpc1exKhClQT20PTw\" target=\"_blank\" rel=\"noopener\">reports<\/a> by Telex showed that a Fidesz-allied businessmen (namely the husband of government spokesperson Alexandra Szentkir\u00e1lyi)\u00a0 secretly won 35-year casino rights. Furthermore, L\u0151rinc M\u00e9sz\u00e1ros, a childhood friend of Prime Minister Orb\u00e1n, has won a big infrastructure tender for Budapest&#8217;s most significant railway development project (Southern Circular Railway). M\u00e9sz\u00e1ros has scored other important government contracts before that.<\/p>\n<p><strong>Hungary extended its migration emergency for the fifth year again by six months<\/strong> due to growing migratory pressure at the border and events in Afganisthan. This state of emergency has been introduced in March 2016 and has been extended every six months since then. Read more <a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2021-09\/cp210143en.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>, 1 September 2021<\/span><\/p>\n<hr \/>\n<h5>Slovakia<\/h5>\n<p>A special committee of the European Parliament led by Sophie in &#8217;t Veld paid a <strong>working visit to Slovakia to see how the fight against corruption is going<\/strong>. The independence of the media and the state of democracy were also on the agenda for this country visit. The EP delegation also visited the parents of journalists J\u00e1n Kuciak and Martina Ku\u0161n\u00edrov\u00e1, who were murdered three years ago.<\/p>\n<hr \/>\n<h5>Slovenia<\/h5>\n<p><strong>Supreme Court decides in row about Slovenian Press Agency.<\/strong> 21 organisations signed a <a href=\"https:\/\/ipi.media\/urgent-solution-needed-as-slovenian-press-agency-funding-crisis-passes-250-days\/\" target=\"_blank\" rel=\"noopener\">joint statement<\/a> calling for an end of the STA (Slovenian Press Agency) crisis. It has been more than 250 days since the STA has last received state funding from the government of Janez Jan\u0161a. The funding has been stopped because of a row over its management and reporting. In the beginning of September, the Slovenian Supreme Court ruled that the government must resume financing the country&#8217;s only news agency, read more <a href=\"https:\/\/www.euractiv.com\/section\/digital\/news\/court-orders-slovenia-government-to-fund-under-fire-news-agency\/\" target=\"_blank\" rel=\"noopener\">here<\/a> on Euractiv, 7 September 2021.<\/p>\n<hr \/>\n<h5>Poland<\/h5>\n<p><strong>Poland&#8217;s KRRiT extended the license of broadcaster TVN24 4 days before the deadline on 26 September<\/strong> after a 19-month delay after the TV station. Earlier in September, the PiS government signed a bill that would block companies that are owned by entities outside the EEA . The bill seemed to particularly aim at the discontinuing the license of American-owned TVN, whose coverage is often critical of the government.<\/p>\n<p><strong>Morawiecki government considers breaking up \u2018sincere cooperation\u2019 principle.<\/strong> As the standoff between the Polish government and the European Commission is continuing, Morawiecki&#8217;s\u00a0 government is considering all possible retaliations to use against the Commission&#8217;s gridlock of EU funds. The Polish government has allegedly made a list of EU projects it intends to block if the EC freezes the EU recovery package. Read more on <a href=\"https:\/\/www.euractiv.com\/section\/politics\/short_news\/morawiecki-government-considers-breaking-up-sincere-cooperation-principle\/\" target=\"_blank\" rel=\"noopener\">Euractiv<\/a> and <a href=\"https:\/\/euobserver.com\/tickers\/153068\" target=\"_blank\" rel=\"noopener\">euobserver<\/a> 29 September 2021.<\/p>\n<p>The European Commission sent letters to five regions controlled by the ruling Law and Justice (PiS) party, urging them to remove the <strong>anti-LGBT declarations adopted by their local governments, otherwise they&#8217;d lose EU funding <\/strong>(<a href=\"https:\/\/www.euractiv.com\/section\/politics\/short_news\/commission-urges-polish-regions-to-drop-anti-lgbt-declarations\/\" target=\"_blank\" rel=\"noopener\">Euractiv<\/a>, 7 September 2021). After these warnings, several Polish regions revoked their anti-LGBT declarations &#8211; however, <strong>16.5% of Polish territory is still covered by \u201cLGBT-ideology free zones\u201d<\/strong> (around 100 towns, regions and villages). Read more on <a href=\"https:\/\/euobserver.com\/tickers\/153008?utm_source=euobs&amp;utm_medium=email\" target=\"_blank\" rel=\"noopener\">euobserver<\/a>, 23 September 2021.<\/p>\n<p><strong>Polish Court Case K 3\/21 about the primacy of EU law over Polish law continues. <\/strong>After several postponements, Case K 3\/21 finally continued on 22 September. To freshen up the memory: K 3\/21 at the Polish Constitutional Court has become a crucial case about whether Polish judges have to apply EU law before the Polish Constitutional Court and whether EU law enables Polish judges to assess other judges&#8217; independence. The case has been lodged by Prime Minister Morawiecki and could lead to a general rejection of the primacy of EU law (one of the core principle of the EU legal order). It could thus be the end of judicial dialogue and a first step of a &#8220;Polexit&#8221; from the EU legal order. Jakub Jaraczewski from Democracy Reporting International has summarised both hearings of K 3\/21 (you can read the thread about the hearing on <a href=\"https:\/\/twitter.com\/J_Jaraczewski\/status\/1440598090197594112\" target=\"_blank\" rel=\"noopener\">22 September here<\/a> and here the one one <a href=\"https:\/\/twitter.com\/J_Jaraczewski\/status\/1443476815817977859\" target=\"_blank\" rel=\"noopener\">30 September<\/a>). The case will continue on 7 October.<\/p>\n<p><strong>European Arrest Warrant, Poland and Rechtbank Amsterdam:<\/strong> for the third time, the <span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">Rechtbank Amsterdam submits preliminary questions to the CJEU concerning the European Arrest Warrant and Polish courts. This <a href=\"https:\/\/uitspraken.rechtspraak.nl\/inziendocument?id=ECLI:NL:RBAMS:2021:5052\" target=\"_blank\" rel=\"noopener\">referral<\/a> concerns the status of Polish judges appointed with the participation of the neo-National Council of Judiciary. The Rechtbank Amsterdam also refers to the questions asked by the Irish Supreme Court in Case <a href=\"https:\/\/curia.europa.eu\/juris\/liste.jsf?lgrec=fr&amp;td=%3BALL&amp;language=en&amp;num=C-480\/21&amp;jur=C\" target=\"_blank\" rel=\"noopener\">C-480\/21<\/a> (<span id=\"pagePrincipale\"><span id=\"mainForm:liste\"><span class=\"affaire_title\">Minister for Justice and Equality).<\/span><\/span><\/span><\/span><\/p>\n<p><strong>Disciplinary Chamber: <span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">Commission has found that Poland failed to implement the CJEU interim order C-204\/21 and judgment C-791\/19<\/span>. <\/strong>On 7 September, the European Commission asked the CJEU to impose a daily financial fine for Poland\u2019s non-compliance with temporary measures that the CJEU ordered in July 2021in Case C-204\/21. The Commission furthermore <span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">initiated the procedure to establish the fact of non-compliance with the C-791\/19 judgment.
